Question About Unemployment Benefits?

I was given a choice to choose between getting fired/layed off and receive no compensation or sign a document saying i resigned and get 2 weeks pay. Either way I was going to lose my job. This was theie idea and i had no desire to leave. they cut 3 other people the same day and had the same alternative presented to them. they did not sign and were fired.
I did sign and it had been 4 months and I am still looking for work. I have a hearing with unemployment soon and wanted to know what you think my chances of winning are.
keep in mind I did not want to leave and both alternatives let to unemployment. I was approached my management and told I was being let go. sign and resign or dont and get discharged.
I signed and received 2 weeks comp I now have a hearing to try and get benefits.
There was no alternative that left me with a job I did not want to leave.

  1. Actually they did that to prevent you from claiming unemployment. To receive unemployment you must have lost employment through no fault of your own. You resigned. Sounds like that paper was basically a waiver of your unemployment benefits. First question asked would generally be “Why are you no longer employed through this company?” to which your reply would be: “I resigned”.
    Sounds unethical, but I’m not sure if it’s illegal. Sorry!

  2. That sounds illegal. I’ve never heard of anything like that before. You may want to seek legal assistance. They enticed you to quit by giving you 2 weeks pay, which I do not believe you will get unemployment benefits out of it.

  3. u did the right thing – theyll give u ur benefits and an extention on them up too 6 mo. usually ( total ) just try n have some proof that youve been lookin work

  4. I’m trying to do the same thing. I think I’m going to be fired soon. I would look for a new job.
