Question by PEG: Employee rights to unemployment insurance due to unfair work request?
My place of employment gave my whole section notice yesterday, that in 3 months our department will be closed down and moved out of state. And were also told that the company is bringing in our replacements and expect us to train them to take over our jobs. Is this unfair work conditions? Would this qualify us to leave sooner and be able to draw unemployment and continue our cobra insurance while looking for a replacement job.

Best answer:

Answer by Crown Royal
Nope. Pretty standard, sorry to say. If you quit, you won’t be eligible for unemployment. That’s how they got you.

Nothing prevents you from looking now, and if you’re lucky, leave early.

how are the employees or employer paid back when unemployment insurance tax is paid by them.
Answer by nosredna
Each state has a state employment (unemployment) office. If you fine yourself unemployed and you meet certain requirements you are entitled to receive an unemployment check. Each state have different guidelines on how much you will receive and the length of time you will be able to receive it (although I think in most cases it is 6 months) GOOD LUCK

Question by myfreeforum: How much will unemployment insurance pay if laid off, and is there any way to supplement it?
I anticipate a layoff within a few months. Does anybody know how much unemployment pays if I cannot find a new job right away? Also, is there any private layoff insurance available to supplement it?

Best answer:

Answer by marilyn_katz
First, I wish you good luck on your job search!

Secondly, state insurance benefits vary by state and by your income. You can find a link to the maximum state unemployment benefits on the website I link to below.

Third…yes, you can purchase a supplemental unemployment protection plan in the US. Again, details are at the link.

Question by superpatzi109: Unemployment insurance…?
In Ontario, Canada how long does it take to get unemployment insurance? Under what conditions do you qualify ?(does it matter if you quit/were fired? What if you quit due to being in a poisioned environment?)? How long do you have to be employed inorder to be elegible for unemployment insurance?

Best answer:

Answer by StephenWeinstein
1. You must be “without work and without pay for at least 7 consecutive days”. “You must serve a 2-week unpaid waiting period before your EI benefits begin to be paid.” If you provide all “the required information and if you can be paid benefits, your payment will be issued usually within 28 days from the date we receive your application.”

2. You qualify only if “you lose your job through no fault of your own, for example, due to shortage of work, seasonal or mass lay-offs and you are available for and able to work but you can’t find a job… If you voluntarily quit your job without just cause or if you are fired due to your own misconduct, you will not be paid….” However, you can receive benefits if you “show that quitting your job was the only reasonable alternative in your case, considering all the circumstances. In other words, you took all the necessary steps to avoid being unemployed.” See http://www1.servicecanada.gc.ca/en/ei/information/voluntarily_leaving.shtml for the list of necessary steps.

3. You must have worked a number of hours which is “based on where you live and the unemployment rate in your economic region at the time of filing your claim for benefits.” Ask Service Canada for the number of hours for your region.
