My place of employment gave my whole section notice yesterday, that in 3 months our department will be closed down and moved out of state. And were also told that the company is bringing in our replacements and expect us to train them to take over our jobs. Is this unfair work conditions? Would this qualify us to leave sooner and be able to draw unemployment and continue our cobra insurance while looking for a replacement job.

No, it is not something you just buy. All employers pay into a large pool for State to have funds for unemployment. Unless you have had certain amount income earned you do not get benefits at all. Check the CA goverment website for all details regarding this topic.

Well in my experience, you will get unemployment money all the way up until your first day worked. Let’s say you start work on a wednesday. You will get money from unemployment for Monday and Tuesday and that’s when your benefit will end.

Each state has a state employment (unemployment) office. If you fine yourself unemployed and you meet certain requirements you are entitled to receive an unemployment check. Each state have different guidelines on how much you will receive and the length of time you will be able to receive it (although I think in most cases it is 6 months) GOOD LUCK

You must be “without work and without pay for at least 7 consecutive days”. “You must serve a 2-week unpaid waiting period before your EI benefits begin to be paid.” If you provide all “the required information and if you can be paid benefits, your payment will be issued usually within 28 days from the date we receive your application.”

2. You qualify only if “you lose your job through no fault of your own, for example, due to shortage of work, seasonal or mass lay-offs and you are available for and able to work but you can’t find a job… If you voluntarily quit your job without just cause or if you are fired due to your own misconduct, you will not be paid….” However, you can receive benefits if you “show that quitting your job was the only reasonable alternative in your case, considering all the circumstances. In other words, you took all the necessary steps to avoid being unemployed.” See http://www1.servicecanada.gc.ca/en/ei/information/voluntarily_leaving.shtml for the list of necessary steps.

3. You must have worked a number of hours which is “based on where you live and the unemployment rate in your economic region at the time of filing your claim for benefits.” Ask Service Canada for the number of hours for your region.
